The associate had completed a pick up and had returned to the store to unload. They parked the van in the loading dock to unload from the back of the van. The associate was standing between the back of the van and building loading dock. They were passing trays of bread up to the receiver who was inside the building.

At this time the Sendik 's [REDACTED] truck arrived to make a delivery. They turned the truck to line up the back of the box truck with the dock door unaware the delivery van was already parked there. The box truck reversed and struck the front of the van pushing the van towards the building hitting the associate. The box truck was unaware that they had struck the van and thought they had clipped a pilon at the entrance to the dock. They straitened out and attempted again striking the van again.

The associate was struck in the back of his legs as the Van moved forward. They fell backwards into the van hitting their head.
