Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
On and prior to 12/4/89.  Employees were subjected to the hazards of
being struck by raised lift or vehicle and/or caught between lift or
vehicle and the floor resulting in fractures, multiple internal injuries
and/or death due to:
Potential failure of the hydraulic system or inadvertent motion to
operating levers for automobile lift which was being operated without
a mechanical device or safety latch to hold it in the raised position.
(a)  The Gilbarko lift was a single post, in ground, frame engaging
design located in the south garage nearest the body shop entrance.  It
is painted yellow with the only indentification stenciled in was
"Northland Supply, Inc. Duluth, MN" and was controlled by a single
lever.
(b)  The two Weaver lifts were dual post, in ground, frame-engaging
designed located in the south bays of the garage area with one next
to the Gilbarko lift and the other nearest the west wall.  One was
painted orange and the other not painted with serial number markings
and were controlled by 3 levers.
Among othe methods,  one feasible and acceptable method to correct the
hazard is to obtain an automatic mechanical device to hold the lift in
the fully extended position,  with a safety factor of not less than 3
based on the rated load capacity, and then to equip the lift with this
device.
The safety shop is stipulated in paragraph 3.2.1 of the American
National Standard Safety Requirements for Construction, Care, and Use
of Automobile Lifts, ANSI B-153.1-1981.
