Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard associated with the lack of an automatic disconnect for a
boom hoist:
a) Rig 1 - A boom hoist disconnect or shut off was not provided to
automatically stop the boom hoist when the boom reaches a
predetermined high angle angle Lima Crawler crane serial number 3530
-40 used marine construction activities on and before 6/15/90.
b) Rig 2 - Bantam model T350 serial number 12650 barge mounted crane
used in marine construction activities on and before 6/16/90.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to provide an automatic device that mechanically
shuts power off to the hoist drum.
