Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
At the Western Stoneware site, employees of Wicks Building Systems
were working on
top of the south wall and were observed exposed to the hazards
associated with falls in
excess of fifteen (15) feet due to the lack of fall protection while
attaching a wooden
plate and truss connecting supports to the top of the wall.
Among other methods feasible and acceptable to correct this hazard
are, but not limited
to:  the use of ladders, scaffolds, catch platforms, scissors lifts,
rotating and articulating
lifts, static lines or safety harnesses and lanyards.
