Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working in confined spaces were subjected to hazards such as, lack of oxygen, toxic vapor, fire and explosion: At this jobsite, employees entered tanks which exposed the employees who were spraying flammable materials to a hazardous atmosphere, such as, but not limited to: a.Employees entered the tanks to paint, without employer evaluating the workplace to determine if any space were permit-required spaces, as referenced in ANSI Z117.1-1989, Section 3.1 Feasible means of abatement method(s) among others, include: A survey conducted of the premises, or operations, or both to identify confined spaces as defined in this standard. b.Employees entered the tanks to paint, and no provisions was made to ensure confined space entry permits were established as referenced in ANSI Z117.1-1989, Section 5.1 Feasible means of abatement method(s) among others, include: Establish entry permits to provide a systematic review for hazards, communicate this information to the occupants and provide an approval sign-off for entries. c.Employees entered the tanks to paint, and no provision was made to conduct atmospheric testing by a qualified person prior to entry that would include a testing sequence of oxygen, flammability and toxicity as referenced in ANSI Z117.1-1989, Section 6.1 Feasible means of abatement method(s) among others, include: Conducting continuous atmospheric monitoring (with alarm) for oxygen deficiency, flammable vapors and toxic vapors. d.Employees entered the tanks to paint, and no provision was made to ventilate to remove atmospheric contaminants from the confined space as referenced in ANSI Z117.1-1989, Section 9.1 Feasible means of abatement method(s) among others, include: Conducting pre-entry purge of several air changes, then continuousintroduction of fresh air during occupancy, in addition the air movers should meet the specifications as outlined in ANSI/NFPA 91-1983 and ANSI Z9.2-1979. e.Employees entered the tanks to paint, and no provision was made to ensure emergency response plan of action was written with provisions to conduct a timely rescue for individuals in a confined space should an emergency arise as referenced in ANSI Z117.1-1989, Section 14.1 Feasible means of abatement method(s) among others, include: Develop a plan of action which would include determination of what methods of rescue must be implement to retrieve individuals; designation of rescue personnel that are immediately available if offsite emergency response personnel used they can respond in a timely manner i.e. within 4 minutes; type and availability of equipment needed; effective means to summon rescuers in a timely manner.
