Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that foot protection was not
provided and/or used when machines or operations presented a potential
foot injury hazard:
a) East area of the jobsite near the kitchen loading dock, where an
employee was observed operating a Best Soil Compactor, serial number
4241110, Gator Equipment Rental I.D. Number 185 without being
protected by adequate foot protection, on or about 5/6/88.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is the wearing of metatarsal foot protection when
operating the soil compactor.
