Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operator's seat and being crushed by an industrial lift truck : a)In the yard of Western Organics, Inc. - The employee operating a TOYOTA lift truck (Serial Number 75902, Model # 42-5FG25) was not using the seat belt, on or about 01/29/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce the use of seat belts on all equipment that has seat belts installed. 1. Ensure that employees utilize seat belts while operating industrial trucks.ial
