Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that health care workers
were exposed to the hazard of being potentially infected by HBV/HIV
through direct contact with blood or other body fluids:
(a)  Residents rooms.  In that nurses carried linen soiled with
body fluids from the resident's rooms, where the linen was used,
through the hallways to the dirty utility room to be laundered
without bagging the soiled linen prior to transport;
(b)  Resident's rooms.  In that nurses carried articles of
clothing from resident's rooms that were soiled with body fluids
and/or blood outside of the rooms and laundered the soiled
articles at home.
While ultimate responsibility for correcting the hazard rests with
the employer, given his/her superior knowledge of the workplace,
feasible and acceptable methods to correct this hazard, among
others are:
(1)  The Infection Control program shall have identified
all laundry operations involving substantial risk of direct
exposure to body fluids.  Linen soiled with body fluids
shall be handled as little as possible and with minimum
afitation to prevent contamination of the person handling
the linen.  All soiled linen shall be bagged at the location
where it was used; it shall not be sorted or rinsed in
patient-care areas.  Soiled linen shall be placed and
transported in bags that prevent leakage; and
(b)  Laundry area.  In that laundry personnel who were engaged
in handling linens contaminated with blood and/or body fluids
were not offered Hepatitis B vaccinations:
(1)  The facility's Infection Control policy regarding
hepatitis B vaccinations shall address all circumstances
warranting such vaccinations and shall identify employees
at substantial risk of directly contacting body fluids.  All
such employees shall be offered hepatitis B vaccinations free
of charge in amount and at times prescribed by standard
medical practices.
