Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to working conditions and recognized hazards of oxygen displacement from inert gases, exposure to aluminum welding fumes, elevated ozone levels and signi- ficant levels of electric current while arc welding in a conductive enclos- ure. (a) Fabrication: Employees enter and weld in confined spaces, aluminum tanks, without following a confined space entry program. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce an adequate confined space entry procedure. Such as stipulated by NIOSH criteria document/publication #80-106, working in confined spaces, which includes, but is not limited to: a. Written procedures covering a permit system prior to tank entry. b. Atmospheric testing of the tank interior. c. Provisions for standby personnel to monitor the activites of the workers in the tank. d. Provide training and provisions for emergency rescue procedures.
