Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from elevation: (a) On or about August 15, 1994, an employee of Williams & Peters Construction Co., Inc., was observed standing in an elevated bucket of a Caterpiller front end loader, Model 950B, identified by the number 404 at the intersection of Broadway and Ave A, Lubbock, Texas. The employee was raised eighteen feet above the asphalt roadway and was engaged in the removal of black plastic from newly installed traffic signal light fixtures. One feasible and accepted method of abatement would be to ensure that employees are not allowed to use the front end loader as an employee aerial lift by imposing stricter guidelines on the supervisory staff regarding the safe operation of their heavy machinery.
