Section 5 (a) (1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to being struck/crushed by
automobile lifts:
a). Auto shop, service bays - Weaver hydraulic vehicle lift was not
equipped with an automatic
mechanical device (safety latch) to hold the lift in the fully extended
position, on or about
01/16/96.
b). Auto shop, service bays - The employer did not ensure that operators
of the lifts were
instructed in the safe use and operation of the lifts using the
manufacturer-provided instructions
and the Automotive Lift Institute publications, "Lifting is Right,
"SM89-1, and "Safety Tips,"
ST90, on or about 01/16/96.
c). Auto shop, service bays - Challenger, electrical/mechanical and
Weaver,
hydraulic lifts, the
employer did not establish a daily inspection, periodic inspection, or a
periodic preventative
maintenance program for the lifts as recommended by the manufacturer to
ensure the safe
operation of the lifts, on or about 01/16/96.
d). Auto shop, service bays - The vehicle lifts did not have an inspection
certificate posted which
would have indicated a previous inspection by a qualified inspector.
Warning labels were not
affixed to the Weaver lift. Operator training logs were not available.
Manufacturer operating
instructions were not available or accessible, on or about 01/16/96.
Among other methods, one feasible and acceptable method to correct this
hazard is to institute
the above needed corrections as required by the manufacturer using their
guidelines or if not
available, following the Automotive Lift Institute document
-ALI-ALOIM-1994 and the
American National Standards Institute document B153.1-1990.
