The alleged violations below have been  grouped  because  they  involve

similar or related hazards that may increase the potential  for  injury
resulting from an accident.
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that braking
mechanisms on machinery were not maintained or were inadequately
maintained:
a)  Overbrook Estates, Dallas Township:  employee(s)
operated a 20 ton Ray Co. Roller (serial #01F848)
on an incline.  The vehicle brake was inadequate to
hold the roller on the incline, thus exposing
employees to injury, November 21, 1991.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD IS TO REPAIR EXISTING
BRAKING SYSTEM TO A CAPABILITY OF STOPPING AND HOLDING
THE ROLLER (WITH ANY AND ALL ATTACHMENT WEIGHTS) FULL
LOADED AND TO ENFORCE STRICT ADHERENCE TO REMOVING
THE ROLLER FROM SERVICE UNTIL BRAKES ARE INSPECTED,
AND DEEMED TO BE SAFE BY A COMPETENT PERSON.
OR IN THE ALTERNATIVE:
29 CFR 1926.602(a)(4): Earthmoving equipment mentioned in this
1926.602(a) did not have a service braking system capable of stopping
and holding the equipment fully loaded:
a)  Overbrook Estates, Dallas Township:  employee(s)
operated a 20 ton Ray Co. Roller (serial #01F848)
on an incline.  The vehicle brake was inadequate to
hold the roller on the incline, thus exposing
employees to injury, November 21, 1991.
