Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that were causing or likely to cause death or serious physical
harm to employees
in that employees were exposed to THE HAZARD OF BEING THROWN FROM A
VEHICLE:
a) Jobsite, on or about 10/18/00: A JBC, Model 530B, rough terrain
forklift was
not provided with seatbelts to protect the operator from the hazard of
being
thrown from the vehicle
ABATEMENT NOTES:
1. Ensure that employees are able to operate this piece of equipment while
wearing a seat belt as required by JCB Loadall Operator's Manual(page 4) by
installing seat belts.
Abatement certification must be submitted for this item.
