Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees.  Employees, while removing a section of concrete from a
sidewalk, were exposed
to being struck by vehicular traffic.  Other hazards included being struck
by construction
equipment such as a crane, which was used in space insufficient for the
lift.
Feasible and acceptable means of correction are to develop procedures to
ensure that traffic
control standards such as the Texas Manual on Uniform Traffic Control
Devices for Streets and
Highways are implemented and to coordinate with all contractors who will
require employees
to work at the site.  Such coordination could be accomplished by the
development of a work
zone traffic control plan prior to the start up of work.
