Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by refuse containers in the process of being emptied into the rear of refuse collection trucks. Site: Various locations throughout Westchester County, including but not limited to Yard at 32 Russell Street , White Plains, N.Y. 10606 On or about 11/26/96: a) Employees operating and assisting in the loading and unloading refuse containers were exposed to the hazard of being struck due to unsafe conditions of the following trucks. 1) Better Carting Service trucks #4 and #8 had U-bolt of the clips staggered and two of the 3 U-bolts applied on the live end of the rope/cable. 2) While facing the rear of the Better Carting Service truck #4, the right side riding step was inclined upwards approximately 45 degrees away from the truck and along the side of the truck. 3) Owner's manual for Better Carting Service trucks #4 and #8 were not available. 4) Better Carting Service trucks #8 was not equipped with hook latches. 5) Better Carting Service truck #8 labeling near the controls was partially covered by wood. 6) Better Carting Service truck #4 did not have an audible warning signal when the vehicle was operated in reverse. 7) Employees utilizing these trucks were not provided with training in the proper dumping procedures. ...AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE TO CORRECT THIS HAZARD IS.... 1) Follow the American National Standards Institute (ANSI) requirements for safe operating procedures, contained in ANSI Z245.1 - 1992, Mobile Refuse Collection and Compaction Equipment - Safety Requirements for Refuse Collection, Processing, and Disposal Equipment, sections 6.1 and 6.2. 2) Provide employees with training as set forth in ANSI Z245.1 - 1992, section 5.1 and 6.1a 3) Repair, prior to placing equipment into service, any mechanical malfunction or breakdown that affects the safe operation of the equipment as set forth in ANSI Z245.1 - 1992 section 5.3 and 6.1.a 4) Conspicuously label controls as to their functions as set forth in ANSI Z245.1 - 1992 section 7.1.4.1. 5) Perform Daily/Monthly inspections as set forth in ANSI Z245.1-1992 standard,section 6.1k. and keep all malfunction reports and records of inspections and maintenance work performed. 6) Utilize the hook latches as set forth in the ANSI Z245.1 - 1992, section 7.2.2.6 7) Provide an audible warning signal device as set forth in ANSI Z245.1 - 1992 section 7.1.15.2.
