Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazard that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was exposed to falling seven feet to the ground below from the top step of
a step ladder:
(a)  On or about March 26, 2008 at the Rite Aid at 1005 3rd Street in
Coneaut
Lake, PA; an employee was changing a component in the electronic sign from
the
top step of a fiberglass step ladder.  The employee was exposed to a seven
foot
fall to the ground below.  One feasible method to correct this hazard
would to use
a ladder of greater length in accordance with the American National
Standard
for
ladders, ANSI A14.5, Section 9.3.2(1) which states that the user shall not
step
or stand on a ladder top cap and top step of a step or trestle, or the
bucket or
pail of a self-supporting ladder.
