5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to falling loads and/or hoists:
a)Foundry Area - The 2 ton Yale hoist was not kept in good repair in
that the hook and nut assembly which secures the hoist assembly to the
railing system seperated while transferring a ladle of hot molten metal;
the entire hoist and ladle fell splashing hot metal and causing burns to
two employees.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to develop a preventative maintenance program which incorporates all
recommendations
outlined in the manufacturer's manuals with written, signed, and dated
reports and also in
accordance with ANSI B30.16 in order to ensure a safe and proper
functioning hoist.
