Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Arden Station Road, Washington, PA; Ford pickup truck, Pennsylvania license YB66334, broken left tailight, General Motors Corporation truck number 2041, taken out of service January 23, 1992 because of defects, Pickup truck 1747, no warning horn, right tailight broken, no emergency brake. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the defects and instruct employees that trucks with defects or trucks that are in anyway unsafe have to be withdrawn from service until restored to safe operating conditions.
