Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the recognized hazard of falling from suspended elevation
while working from
a JLG lift, model 110HX, serial # 013710-03000-20004, located at the west
end of the scrap
yard.

to ensure that the
area in which the lift will be used is inspected for possible hazards in
accordance with
Paragraphs 7.7, 7.8, and 7.9 of the American National Standards Institute
(ANSI) A92.5-1992,
