Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazards of:
a) falling from the side of the Case 580M backhoe-loader and being struck
by the tractor's tires
or by other vehicular traffic on the street;
b) being crushed by the tractor or roll over protective structure in the
event the tractor was
struck by a vehicle while traveling on the street.
On or about January 24, 2005, at the worksite located adjacent to the St.
Vincent
Infirmary employee parking lot across from 5700 West Markham Street in
Little Rock,
Arkansas, the employee operating the Case Model 580M backhoe/loader was
observed
ferrying another employee between the work area and the material staging
area, a
distance of approximately one-half mile.  The "passenger" employee was
observed
standing on the left-side runner board and holding onto the front left
vertical support of
the rollover protective structure.  The route of travel was east on a
high-traffic-volume
secondary traffic artery through the city.
One feasible and acceptable abatement to correct this hazard is to
prohibit unauthorized
passengers (those who are not provided a safe place to sit, in that they
would be
protected by the concurrent use of a seat and seat belt assembly protected
by the rollover
protective structure).

exposed to the hazards of being ejected from the bucket of the Case 580M
backhoe-loader and
being struck by the tractor's tires or by other vehicular traffic on the
street:
On or about January 24, 2005, at the worksite located adjacent to the St.
Vincent
Infirmary employee parking lot across from 5700 West Markham Street in
Little Rock,
Arkansas, where an employee was observed riding in the bucket of the Case
Model
580M backhoe/loader as the tractor was transporting a single joint of
8-inch diameter,
40-feet long high pressure gas line from the material storage area to the
work area, a
distance of approximately one-half mile.
The "passenger" employee was observed standing in/sitting on the front
bucket,left side,
as he was holding the section of pipe on top of the bucket in an effort to
prevent it from
bouncing off.  The rear of the pipe section was held aloft by the upraised
rear left
outrigger.
The route of travel was west on a high-traffic-volume secondary traffic
artery through
the city.  The tractor had to make a left-hand turn from the material
storage street onto
W. Markham Street, crossing the flow of the east-bound traffic.
Among other methods, one feasible and acceptable abatement to correct this
hazard is to
secure the pipe to the tractor using a sling, rope, chain, or strap.  A
second method is
to prohibit employees from using the bucket as a work platform or
personnel carrier, as
instructed by the on-board copy of the backhoe/loader safety manual
drafted by AEM
(formerly Equipment Manufacturers Institute) revised in August of 2002.
