Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On the site at 5488 Warrensville Center Rd., in Maple Heights, Ohio, an employee was working on a self propelled work platform (Economy Sizzor Lift) Model #SP-2130, Serial #FH 70264 without all guardrails in place and fell 16-feet to the concrete floor below which resulted in his death.
