Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were causing or likley to cause death or serious physical harm to employees in that employees were exposed to: (a) On 6/11/93, employees were exposed to the hazard of broken bones, internal injuries or death from falls while performing job duties, including removing plywood barriers, hanging tarps, blast stripping and painting, by standing or climbing on the structural members of the bridge forming the overpass of Rt. 91 over I-90 (ODOT Project #903-91), approximately 16-24 feet above the ground. They were not using any method of fall protection. (b) On 7/8/93, employees were similarly exposed to fall hazards while standing or climbing on the structural members of the bridge, as described above. In addition, employees were standing on the midrail and toprail of the scissor lift while spray painting, approximately 16-18 feet above the ground, without fall protection. Feasible methods of abatement include, but are not limited to, the use of fall protection systems such as static and/or catenary lines in conjunction with safety belts and lanyards, nets, aerial lifts, catch platforms and scaffolding.
