Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries due to being struck by falling portions of the building structure: (a) On the 9th of April, 1999, employees working on a front porch structure at a residential construction site were exposed to structural collapse hazards, due to inadequate bracing and supports to assure structural integrity under appropriate wind load conditions including the 58 mile per-hour winds to which it was exposed. Bracing and supports did not meet the recognized specifications for Minimum Design Loads for Buildings and Other Structures as required by the American National Standards Institute (ANSI), and American Society of Civil Engineers (ASCE 7-95), for requirements of dead, live, soil, flood, wind, snow rain, ice, and earthquake loads and their combinations, that are suitable for inclusion in building codes (as referenced in section 6-1 "Wind Loads", and those found in and in the 1989 edition, Council of American Building Officials (CABO), One and Two Family Dwelling Code which provides a minimum requirements to safeguard life or limb, health, and public welfare and the protection of property as it relates to these safeguards by regulating and controlling the design, construction, prefabrication, equipment or appliance installation, quality of materials, use and occupancy location and repair of detached one- or two-family dwellings, not more than three stories in height as referenced for "Fastening Schedule", Table 2305.2 Building Element 3, Roof and Ceiling Construction and design building design criteria an specifications in section 301.2 and table 301.2b. Among other methods, one feasible and acceptable method to abate this hazard is the installation and bracing of the structure in accordance with ANSI/ASCE and CABO specifications.
