Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to pinch points on material handling equipment: a) On 9-05-07, an employee, attaching a riding trowel to the forks of a skidsteer with a lifting strap, was exposed to the hazard of machinery pinch points. When the lever was activated, it caused the lifting arms to go down and pin the employee between the arms and the frame of the skidsteer. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to: Comply with the Thomas 233 skidsteer owner's and operator's manual: "Never enter or leave the loader while the engine is running. Always lower the lift arms against the frame, drop the bucket to the ground, set the parking brake and shut off the engine prior to leaving the loader." Comply with the Equipment Manufacturers Institute Safety Manual for users and operators of skidsteers: "Keep your body inside of the operator's cab while operating the skidsteer loader. Never work with your arms, feet or legs beyond the operator's compartment." Abatement Certification and Abatement Documentation required.
