Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to the hazards of oxygen deficiency and/or dangerous accumulation of vapors (such as xylene, methyl isobutyl ketone, n-butanol) while entering and painting inside a water storage tank on or about 5/22/97. These exposures could result in asphyxiation and/or delayed rescue. The hazards resulted from deficiencies in the company's confined space entry program, which were: 1. Failure to use a confined space permit entry system including but not limited to posting, testing/monitoring the atmosphere, choice of appropriate respiratory protection and effective ventilation. 2. No effective means of communication for summoning rescue sources. Among other methods, feasible ways to correct these hazards are: 1. Develop, implement and complete a confined space permit entry system meeting the requirements of OSHA 1910.146 and/or ANSI Z117.1-1989. The program should include: (a) Effective training of the authorized entrants, attendants and all affected employees. (b) Completion of all portions of the permit to specify the nature of the work to be completed and necessary equipment, including rescue equipment. (c) Continuous air monitoring where there is the potential for the build up of hazardous vapors. (d) Provision of effective means of communication by the attendant to necessary rescue services.
