Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 19.5 feet to the ground below: Northeast corner of the motel - Employees were unprotected from falls while riding on a platform lifted on the forks of a Track International rough terrain forklift, model #6036. Among other methods, one feasible and acceptable abatement method to correct this hazard is to utilize a personnel platform with a restraining means, such as a guardrail system, as stipulated in ASME B56.6-1992, American National Standard for Rough Terrain Forklift Trucks, section 5.15.1.
