Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about November 14, 2001, in the south atrium area, an employee standing on a single 2 inch by 12 inch wooden plank, which had one end setting on the end frame of a fabricated frame scaffold and the other end setting on the platform of the JLG Commander scissors lift, model number CM2033, was exposed to the hazard of falling 19.5 feet to the concrete floor below, due to the unauthorized use of a deck extension/attachment to the lift. Among other methods, one feasible and acceptable method of abatement includes, but is not limited to operating the JLG Commander scissors lift in accordance with the instructions located in the Operator's Manual and ANSI/SIA A92.6 - 1999, American National Standard for Self- Propelled Elevating Work Platforms which state the following: OPERATOR'S MANUAL - SECTION 1-6 OPERATION Do not attach overhanging loads to the platform or increase the platform size with unauthorized deck extensions or attachments. Always stand on platform floor, not boxes, planks, or railings. When riding in or working from platform both feet must be firmly positioned on deck. Do not extend reach limits of this machine with additional equipment, such as planks, boxes, etc. ANSI/SIA A92.6-1999 - RESPONSIBILITIES OF THE USER AND RESPONSIBILITIES OF THE OPERATOR Personnel footing. Personnel shall maintain a firm footing on the platform while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited. The use of planks, ladders, or any other devices on the platform for obtaining additional height or reach is prohibited.
