Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fractures and death from falling off the midrail and top
rail of a self propelled
elevating work platform:
(a) Employees stood on the midrail and top rail of a New Reach elevating
work platform while
working on the block structure and placing rebar down the core holes of
the dumbwaiter
structure. Employees were exposed to a fall hazard of over 20 feet from
the top rail to floor
level.  These practices are recognized hazards per American National
Standards Institute (ANSI),
A92.6-1990, Self Propelled Elevating Work Platforms, paragraphs 7.11.1 and
8.10.1.
