Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling 17 feet to the bottom of the trench from the
bucket of an excavator:
JOBSITE: An employee was allowed to ride the bucket of the Komatsu, Model
PC 220LC,
Excavator to access the 17-foot deep trench.
Among others, one feasible and acceptable abatement method is to:
1- Prohibit the employees from riding on the excavator or its attachments.
2- Provide employees with a safe means of access to/from the trench.
3- Use other safe means.
