Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the employee
was exposed to the hazard of falling from or being thrown from the bucket
of a backhoe.
Jobsite: The employee was tying up a telephone line from the bucket of a
backhoe
,approximately 15 feet above ground level.
Among other methods, one feasible and acceptable method of abatement is
for the employee to
use an aerial lift complete with harnesses and lanyards.
