employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about September 23, 2005 at a job site located in Benton, Arkansas at 11348 Interstate 30, where the operator of the model 5028 Sky Trak rough terrain powered industrial truck, serial number 0232, was observed traveling around the construction site without the seat belt engaged. This practice exposed the operator to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operators to wear their seat belt at all times when he is sitting in the seat of the powered industrial truck, regardless of the length of time that he will be in the seat, as warned by the manufacturer of the lift in a warning posted behind the seat.
