Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about 4/5/2007 and times thereto, with respect to a job site located
in Cabot,
Arkansas at 850 South Stagecoach, where the operator of the SkyTrak Model
6036 rough
terrain powered industrial truck, serial number P975814335,  was observed
traveling
throughout the construction site without his seat belt engaged.  This
practice exposed the
operator to the hazard of being ejected and crushed by the machine in a
roll-over
accident.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to require the operators to wear the provided seat belt at all
times
when he is
sitting in the seat of the powered industrial truck, regardless of the
length of time that
he will be in the seat, as warned by the  manufacturer of the lift in a
warning posted
behind the seat.
