Va. Code 40.1-51.1A.: The employer did not furnish employment and a place
of
employment, which were free from recognized hazards that were causing, or
likely
to cause, death or serious physical harm to employees, in that an employee
was
exposed to crushing and engulfment hazards while operating a tractor to
push
manure into a 10 foot deep manure pit.
One feasible and acceptable method to correct this hazard would have been
for the
employer to enforce, with progressive levels of discipline, its policy
prohibiting the driver from approaching too closely to the top of the ramp
and
prohibiting the driver from looking backwards while the tractor was
ascending the
ramp.ding
