A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees, in that an employee was working at the 40' deep level of an excavation next to the vertical sidewall of the excavation and the swinging superstructure of a John Deere track hoe. (a) East side of Price Road south of the Western Canal: One (1) employee was working in a section of an excavation that was 40' deep, (the entire excavation was 39' wide, 113' long, and 55' deep at the deepest location) next to the vertical sidewall and was exposed to the swinging superstructure of the John Deere track hoe, model number 892ELC.
