Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious hazards of crushing and/or possible death, while dumping scrap cardboard boxes into trash compactor which had the safety interlock(s) by-passed: a) Stock Room, Piqua series 30 baler, the limit switch on the ram was wired so as to eliminate the safety function of the gate assembly, and a screw driver was wedged in another part of that safety assembly the counter balance limit switch; 3-14-90
