Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to the
hazard of falling 26 feet 8 inches and 25 feet 9 1/2 inches to the ground:
a)  Roof of building - employees welding structural steel at heights
of 26 feet 8 inches and 25 feet 9 1/2 inches above ground level were
not protected from falling, on or about June 25, 1993.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to provide and ensure the use of safety belts and lanyards
or other equivalent fall protection.
Or, in the alternative,
29 CFR 1926.105(a): Safety nets were not provided when workplaces were
more
than 25 feet above the ground or water surface, or other surfaces where
the
use of ladders, scaffolds, catch platforms, temporary floors, safety
lines,
or safety belts was impractical:
a)  roof of building - employees welding steel at heights of 26 feet
8 inches and 25 feet 9 1/2 inches above ground level were not
protected from the hazard of falling to the ground by safety nets or
other equivalent fall protection.
