Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized fire and explosion hazards associated with an improperly equipped and operated spray booth. Employees at the feed yard are exposed to fires and burns due to electrical equipment, which is not approved for flammable vapor environments, being used in the spray booth and due to combustible material being stored in the booth. Two halogen lights and a drill, which were not approved for the hazardous location, were stored and used in the spray booth. Combustible materials such as lumber and boxes were being stored in the spray booth. "NO SMOKING" signs were not posted in the area. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to the following: a)Install correct portable lighting and electrical equipment or remove the portable lights and drill from the spray booth in accordance with National Fire Protection Association (NFPA) 33 - 1995. b)Remove the combustible material from the spray booth in accordance with NFPA 33 - 1995. c)Post "NO SMOKING" signs in accordance with NFPA 33 - 1995. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized health hazards, chemical and particulate exposure, associated with uncontrolled and inadequate respirator usage. Employees at the cattle yard are exposed to the hazards associated with respirator usage. Half mask respirators are used in the spray booth due to particulate and chemical vapor exposure and dust masks are used at the employees discretion throughout the rest of the facility due to dust, including grain dust, exposure. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: a)Employer shall establish and maintain a respiratory protection program that includes the requirements outlined in Section 4.5 of American National Standards Institute (ANSI) Z88.2 - 1992. b)Employer shall establish an individual to be assigned the responsibility and authority for the administration of the respirator program as outlined in Section 5 of ANSI Z88.2 - 1992. c)Employer shall establish and maintain written standard operating procedures for respirator usage as outlined in Section 6 of ANSI Z88.2 - 1992. d)Employer shall provide adequate training to ensure the proper use of respirators as outlined in Section 8 of ANSI Z88.2 - 1992. e)Employer shall provide a qualitative or quantitative respirator fit test to determine the ability of each individual respirator wearer to obtain a satisfactory fit with a tight-fitting respirator as outlined in Section 9 of ANSI Z88.2 - 1992. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized electrical shock hazards associated with improper electrical installations. Employees are the feed yard facility were exposed to electrical shock hazards and injury due to electrical installations not meeting the National Electrical Code (NEC). A four plex receptacle inside of the Mill Office was not effectively closed and a section of conduit was pulled apart from a junction box north of the Mill Office. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: a)Install a four plex receptacle which is listed for the location and use and which is effectively closed, i.e. no open knockouts. b)Reattach conduit to the junction box. Employees at the feed yard are exposed to severe injury or death from a fall when accessing the entrance holes on the tops of the whole corn storage bins. Employees are exposed to a fall of approximately 40 feet. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited ot the following: (a)Install standard railings on the bins in accordance with American National Standards Institute (ANSI) A12.1 -1967. (b)Install fall protection on the bin in accordance with ANSI Z359.1 - 1992. Abatement certification is required for this violation. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical farm to employees in that employees were exposed to the recognized fire and explosion hazards associated with the presence of ignition sources in a dusty environment. Employees at the feed yard facility are exposed to fire/explosion hazards due to the use of a spark-producing steel scraper to clean the inside of the corn and the soy meal bins. General precautions for dusty environments identified in National Fire Protection Association (NFPA) 63 -1971 include the elimination of all sources of ignition because many dusts may be ignited by very low energy sparks. Among other methods, feasible and acceptable abatement methods to correct his hazard include, but are not necessarily limited ot the following: a)Use a scraper/shovel made of a non-spark producing material in accordance with NFPA 61C - 1973. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards of asphyxiation, chemical exposure and physical injury associated with inadequate confined space entry and rescue systems and procedures. a)Employees at the cattle yard facility are exposed to the hazards associated with inadequate confined space retrieval/rescue. Employees were accessing the grain bins without an adequate means of retrieval/rescue of the employees. On April 13, 1999, two employees were engulfed and asphyxiated in the confined space of the corn bin. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: i)The employer shall implement safeguards such as rescue equipment as outlined in Section 12 of ANSI Z117.1 - 1995. b)Employees at the cattle yard facility are exposed to the hazards associated with confined spaces. Employees were accessing confined spaces, such as, bins and scale pits, at the establishment without adequate oversight, preparation or safety precautions. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: i)The employer shall identify and evaluate the establishment for hazard identification as outlined in Section 3 of American National Standards Institute (ANSI) Z117.1 - 1995. ii)The employer shall implement an entry permit system as outlined in Section 5 of ANSI Z117.1 - 1995. iii)The employer shall conduct atmospheric testing as outlined in Section 6 of ANSI Z117.1 - 1995. iv)The employer shall follow all attendant requirements as outlined in Section 7 of ANSI Z117.1 - 1995. v)The employer shall perform isolation and lockout/tagout as outlined in Section 8 of ANSI Z117.1 - 1995. vi)The employer shall implement warning signs and symbols as outlined in Section 13 of ANSI Z117.1 - 1995.vii)The employer shall implement an emergency response plan as outlined in Section 14 of ANSI Z117.1 - 1995. viii)The employer shall conduct training as outlined in Section 15 of ANSI Z117.1 - 1995. ix)The employer shall appraise contractors of confined spaces as outlined in Section 17 of ANSI Z117.1 - 1995. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.
