Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing injuries:
Employees of Shelbyville Disposal are exposed to the hazard of being
struck by the container
which is not held in place by a container latch.  These latches are used
to positively attach a
refuse container to the packer and prevent it from coming loose from the
tailgate and striking
the employee.  Three of the four truck routes pick up refuse disposed of
in containers.
Among other methods, a feasible and acceptable abatement method to correct
this hazard would
be to install the container attachments on each tailgate and truck that is
used in conjunction with
container refuse collection.
