Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by falling materials and/or
equipment:
Employees operating the Cleveland Tramrail, underhung crane, with the Yale
underhung hoist,
Komatsu Asset #6971, were exposed to being struck by falling materials and
equipment due to
the fact that the employer did not ensure that the frequent inspections on
the crane and the hoist
were performed on at least a monthly basis.
Feasible and acceptable abatement can be expected to include, but is not
limited to:
a.  Provide frequent inspections of the crane and the hoist in accordance
with
ANSI/ASME B30.11- 1998 Section 2.1.2 and B30.16 - 1998 Section 2.1.2.
b.  Remove the crane and hoist from service until the appropriate
inspections have been
performed.

the fact that the employer did not ensure that employees were not allowed
to be lifted, lowered,
or carried on the load or the hook.
Feasible and acceptable abatement can be expected to include, but is not
limited to:
Ensure that employees are not allowed to operate the crane or hoist while
employees are
on the load or the hook. ANSI/ASME B30.11- 1998 Section 3.2.3(e),  B30.16
- 1998
Section 3.1.3(j) and Yale Safe Hoisting Practices #29.
