Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(1) The hazard of falling from a Boom-Supported Elevating Work Platform
and
(2) The hazard of being struck-by or crushed-by the collapsing boom or
falling load.
At the job site located at 3304 14th St. Eau Claire, WI employees were
using the work platform
without wearing a personal fall arrest system. The work platform had also
been modified and
was being used as a crane to lift wood trusses being installed on top of
the second floor.
Among feasible means of abatement would be to comply with American
National Standards
Institute (ANSI) A92.5 - 1992 Standard for Boom-Supported Elevating Work
Platforms:
provide
and require that the employees operating the work platform wear personal
fall arrest equipment
as required by Section 8.8(g) and do not use the platform as a crane which
is prohibited by
Section 8.10.12 of the Standard.
