Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were allowed to cross a public highway with an in-plant railroad
without knowing
that the West Gate security guard was in place and in sight along the
southbound side of
Philadelphia Pike, putting the guard in danger of being struck by the
train:
a)  West Gate Area - the in-plant train, crossing Philadelphia Pike from
east to west
without the security guard in place along the southbound side of the road,
struck and killed
the security guard;  November 12, 1999
Among other methods, one feasible and acceptable method to correct this
hazard is to:
1 - Ensure that the company's road crossing procedure is adhered to at all
times.
2 - Require the security guard at the main gate to contact the West Gate
guard to notify him
that the train is crossing the road.
