Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and
a place of employment which were free from recognized hazards that were
causing or likely to cause death or
serious physical harm to employees in that employees were exposed to:
(a)  Being struck by Roadtec SB 2500 Material Transfer Vehicle while
vehicle was moving from a work
area on U.S. Hwy. 190 to a storage area approximately 1/4 mile away.  The
operator's view was
obstructed on either side adjacent to the vehicle and forward for a
distance of approximately 30 feet.  The
employer could have protected his employees by such means as having an
observer (flagman) available on
the ground and always in full view of the operator to assist and make sure
the area around the machine is
clear, and signal that it is safe to move the machine in either direction.
This condition occurred on or about Nov. 6, 1996.
