Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being infected with Mycobacterium
tuberculosis through
unprotected contact with patients who were infectious or suspected to be
infectious with
tuberculosis in that:
(a).On or about 9/25/97 in Unit 9 North; the employer did not assure daily
that an AFB
isolation room (#910), which was being used to isolate a suspect TB
patient from 9/22/97
to 9/25/97, was maintained under negative pressure.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the
CDC, include, but are not limited to, visually verifying that negative
pressure exists in
isolation rooms daily by performing a smoke tube test.
(b).On or about 10/10/97 in Unit 10 North; the employer did not assure
daily that an AFB
isolation room (#1012), which was used to isolate a suspect TB patient
from 9/29/97 to
10/10/97, was maintained under negative pressure.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the
CDC, include, but are not limited to, visually verifying that negative
pressure exists in
isolation rooms daily by performing a smoke tube test.
