Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by machinery and falling loads. a) Scrap Metal Yard - The Drott hydraulic excavator was not maintained in compliance with manufacturers specifications. The seal on the lift cylinder was visibly leaking hydraulic fluid, on or about 07/11/97. Feasible abatement methods include but are not limited to replacement or repair of the lift cylinder.
