Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Volumetric Testing Department and surrounding areas - The work area, including but not limited to floors, tables, worktops, and equipment was not maintained free of mercury contamination. On or about 11/17/98. b) Volumetric Testing Department - Employees consume their lunches and breaktime snacks at tables contaminated with mercury. On or about 11/17/98. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: a) Relocating the Volumetric Testing Department to an isolated area, thoroughly cleaning the area where the Volumetric Testing Department currently exists, removal and disposal of contaminated materials, and sealing the floor with a smooth, seamless covering. b) Prohibiting the consumption of food or beverages in the area. ABATEMENT NOTE: in accordance with 29 CFR 1903.19 Abatement Verification, the employer will provide abatement certification to the Area Director within 13 calendar days of the final abatement date for this violation. The employer must provide written documentation (in the form of area sampling results for mercury) verifying that the work area has been decontaminated, and written proof that employees no longer consume food or beverages in the Volumetric Testing Department.
