Section 5(a)(1) of the Occupational Safety and Health Act of 1970 reference Section 4-3.1.3.(l) American National Standards Institute B30.4-1973 Safety Standards for Portal, Tower, and Pillar Cranes: Cranes shall not be operated when wind speeds exceed 45 miles per hour or lower velocities when recommended by the manufacturer. USCG Yard, pier 1 - Portal tower cranes are not tied-down when specified wind speeds are exceeded. The USCG has a policy that requires cranes to be tied-down when winds are steady between 35 and 40 MPH. Wind indicating devices are located in each tower crane. Foreman and operators are knowledgeable of the policy. However, foreman interviewed stated they allow crane operators to use their own discretion when shutting-down the crane. On this day the foreman said the operators were getting readings of 50 and 55 MPH, but the crane continued to operate. The foreman said that with a heavy lift the cranes are not as likely to blow over.
