Title 23 V.S.A. Chapter 3, Subchapter 5, Section 223(a): Section 5(a)(1)
of the Occupational
Safety and Health Act of 1970:  The employer did not furnish employment
and a place of
employment which were free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that employees were exposed to
hazards of an
improperly constructed dumb waiter.
Location:  Southwest corner of rear of store
Violation: The employer had not furnished a place of employment that was
free from recognized
hazards that were likely to cause death or serious physical harm, in that
employees were exposed
to hazards created by an improperly constructed/installed, homemade,
dumbwaiter, that would
expose employees to being struck by the dumbwaiter car when the lifting
mechanism failed.
Among other methods, one reasonable and acceptable method to correct this
hazard is to comply
ANSI A17.1, concerning the proper construction/installation and safety
requirements
for
dumbwaiters.
