Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The hazard of being struck and ran over by the Caterpillar 920 payloader
while the payloader
was backing up to bin #3, for another load of crushed aluminum.  An
employee was in close
proximity to the backing vehicle which did not have a clear view to the
rear and did not have
a back-up alarm.
Among other methods, one feasible and acceptable method to correct this
hazard would be to
install back-up alarm(s) on the payloader and another to vehicle(s), with
an obstructed view to
the rear, that would sound when the vehicle(s) moved in reverse.
