Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing injuries from powered industrial trucks in the
event of a roll over
without the use of seatbelts/passive restraint device. On August 9, 2001,
an employee operating
a Toyota forklift Model 7FGCU25 on the Tipping Room floor was not wearing
a seatbelt when
the powered industrial truck dropped onto the recessed conveyor and tipped
over. The use of
seatbelts throughout the Warehouse and the Tipping Room was not enforced.
The operators
manual for the Toyota powered industrial truck states the requirement for
drivers to wear
seatbelts at all times in the event that a roll over should occur.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to review and train employees who operate powered industrial trucks the
specific requirements
for seatbelt usage as directly outlined by the respective powered
industrial trucks' operators
manual.
