North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and place(s) of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards related to hoist failure and falling suspended loads: a)Plant & detail shop - Budgit (2 ton/ 240 vac/pendant controlled) wall mounted jib underhung chain hoist (11ea.) fitted with hooks(not i.d. stamped) and synthetic web slings were not routinely inspected, tested and records maintained in accordance with American National Standards Institute safety standards for cranes, hoists and slings(ANSI B30.16/ASME 1981). Re: sections 16 -2,1, 16-2.5 One feasible method to abate this condition would require the development and implementation of inspection procedures and records maintenance in accordance with the manufacturer's documentation manual and ANSI B30.16/ ASME 1981.
